Terms & Rental Agreement

Effective Date: August 21, 2026

These Equipment Rental Terms & Agreement ("Agreement") govern the rental of photography, videography, audio, lighting, drone, and related equipment ("Equipment") from Daniel Mac Media Rentals ("Daniel Mac Media Rentals," "we," "us," or "our") to the individual or organization renting the Equipment ("Renter," "you," or "your").

By submitting a rental request, making payment, accepting delivery, or taking possession of any Equipment, you acknowledge that you have read, understood, and agreed to these terms.

1. Rental Booking

All rental requests are subject to availability and approval by Daniel Mac Media Rentals.

A rental is not considered confirmed until:

  • The rental has been approved by Daniel Mac Media Rentals.
  • The required rental payment has been received.
  • Any required security deposit or authorization has been completed.
  • The Renter has agreed to these Terms & Agreement.

We reserve the right to decline or cancel a rental request where appropriate, including where Equipment is unavailable or the Renter does not meet our rental requirements.

2. Rental Period

The rental period begins on the scheduled rental start date and ends on the scheduled rental end date stated on the Renter's booking confirmation.

Equipment is generally shipped to the Renter before the rental period begins and returned after the rental period ends.

Our standard shipping process is:

  • Day before rental: Equipment is dropped off with the shipping carrier.
  • Rental start date: Rental period begins.
  • Rental end date: Rental period ends.
  • Day after rental: Equipment is scheduled for carrier pickup.

The Renter remains responsible for the Equipment throughout the rental period and until it has been properly packaged and handed back to the designated carrier in accordance with the return instructions.

3. Shipping & Delivery

Equipment may be shipped using a third-party shipping carrier selected by Daniel Mac Media Rentals.

We will make reasonable efforts to ship Equipment according to the scheduled shipping timeline. However, Daniel Mac Media Rentals is not responsible for delays caused by the shipping carrier, weather, transportation disruptions, incorrect addresses, or circumstances outside our reasonable control.

The Renter is responsible for providing an accurate and complete shipping address.

If Equipment is delayed in transit through no fault of the Renter, the parties may work together to determine an appropriate resolution based on the circumstances.

4. Return of Equipment

The Renter must return all Equipment and included accessories using the return method and packaging instructions provided by Daniel Mac Media Rentals.

Unless otherwise agreed in writing:

Equipment must be ready for carrier pickup on the day after the rental end date.

The Renter is responsible for ensuring that the Equipment is properly packaged, secured, and available for pickup.

Failure to make Equipment available for the scheduled return may result in additional rental charges, shipping costs, or other applicable charges.

5. Equipment Condition

Daniel Mac Media Rentals will make reasonable efforts to ensure that Equipment is clean, functional, and in rental-ready condition before shipment.

The Renter should inspect the Equipment promptly after receiving it.

Any pre-existing damage or issues should be reported to Daniel Mac Media Rentals as soon as reasonably possible after delivery.

If an issue is not reported promptly, it may be presumed that the Equipment was received in acceptable condition, subject to evidence showing otherwise.

6. Proper Use of Equipment

The Renter agrees to:

  • Use the Equipment only for lawful purposes.
  • Operate the Equipment responsibly and in accordance with manufacturer instructions.
  • Take reasonable care to prevent damage, loss, theft, or misuse.
  • Not modify, disassemble, repair, or alter Equipment without written authorization.
  • Not remove serial numbers, identification labels, or other markings.
  • Not rent, lend, sell, transfer, or otherwise provide the Equipment to another person without written permission.
  • Use appropriate protective equipment, cases, bags, and accessories where applicable.

The Renter is responsible for having sufficient knowledge and experience to safely operate the rented Equipment.

7. Damage, Loss & Theft

The Renter is responsible for the Equipment from the time it is delivered until it is returned to Daniel Mac Media Rentals or properly handed to the designated return carrier.

The Renter may be financially responsible for:

  • Accidental damage.
  • Negligent damage.
  • Water or liquid damage.
  • Fire damage.
  • Theft.
  • Loss.
  • Missing Equipment or accessories.
  • Damage caused by improper use.
  • Damage caused by unauthorized modifications or repairs.
  • Damage caused during return shipping due to improper packaging.

The Renter may be charged for reasonable repair costs, replacement costs, parts, labour, shipping, or other expenses necessary to restore or replace the Equipment.

8. Security Deposit

Certain rentals may require a refundable security deposit.

The security deposit is intended to protect Daniel Mac Media Rentals against damage, loss, theft, missing accessories, excessive cleaning requirements, late returns, or other amounts owed under this Agreement.

Following the return and inspection of the Equipment, the security deposit will be returned where there are no outstanding charges.

If amounts are owed, Daniel Mac Media Rentals may deduct the applicable amount from the security deposit.

If the costs exceed the security deposit, the Renter remains responsible for the remaining balance.

9. Normal Wear & Tear

The Renter will not normally be charged for reasonable wear and tear resulting from proper use of the Equipment.

However, damage beyond normal wear and tear may result in charges.

Examples may include, but are not limited to:

  • Broken components.
  • Cracked screens or displays.
  • Damaged lenses or optics.
  • Significant scratches or dents.
  • Liquid damage.
  • Glue, adhesive, tape, or residue that requires specialized cleaning or repair.
  • Missing cables, batteries, chargers, cases, or other accessories.
  • Damage caused by improper mounting or installation.

10. Cleaning & Residue

Equipment must be returned in reasonably clean condition.

The Renter may be responsible for reasonable cleaning or restoration costs where Equipment is returned with excessive dirt, debris, adhesive, glue, tape residue, makeup, food, liquids, or other substances that cannot be removed through ordinary cleaning.

11. Late Returns

Equipment must be returned according to the agreed rental schedule.

If Equipment is not made available for the scheduled carrier pickup, Daniel Mac Media Rentals may charge additional rental fees or other reasonable costs resulting from the delay.

Where a late return affects another customer's rental, the Renter may also be responsible for reasonable costs resulting from the delay.

If you know that you will be unable to return Equipment on time, you must contact us as soon as possible.

12. Shipping Damage

If Equipment arrives damaged, the Renter should:

  1. Photograph the shipping box and packaging before opening it where possible.
  2. Photograph any visible damage to the Equipment.
  3. Contact Daniel Mac Media Rentals as soon as possible.
  4. Keep the original packaging and shipping materials until instructed otherwise.

The Renter should not attempt repairs unless authorized by Daniel Mac Media Rentals.

13. Cancellation

Cancellation requests must be submitted to Daniel Mac Media Rentals as soon as possible.

Any applicable cancellation fees, refunds, or credits will be determined according to the cancellation terms provided at the time of booking.

Certain rentals may be subject to non-refundable payments where Equipment has already been reserved, prepared, or shipped.

14. Rental Extensions

Rental extensions may be available upon request.

An extension is not guaranteed and must be approved by Daniel Mac Media Rentals before the original rental end date.

Equipment cannot be assumed to be available for an extension, particularly where another customer has a reservation.

15. Equipment Availability & Substitution

While we make reasonable efforts to provide the Equipment listed in the booking, circumstances such as equipment failure, loss, damage, or other unforeseen events may occasionally affect availability.

Where possible, Daniel Mac Media Rentals may provide comparable replacement Equipment or another reasonable solution.

If suitable replacement Equipment cannot be provided, Daniel Mac Media Rentals may issue an appropriate refund for the affected portion of the rental.

16. Personal Information

Daniel Mac Media Rentals may collect information reasonably necessary to process and administer a rental, including contact information, shipping information, identification information, payment information, and rental records.

Personal information will be handled in accordance with applicable Canadian privacy laws and our applicable privacy practices.

17. Identification & Verification

Daniel Mac Media Rentals may require valid identification, contact information, and other reasonable information before approving or releasing a rental.

We reserve the right to request additional verification where reasonably necessary to protect our Equipment and business.

18. Prohibited Uses

Equipment may not be used for unlawful activities or in a manner that creates an unreasonable risk of damage, injury, or loss.

The Renter is responsible for complying with all applicable laws, regulations, permits, and manufacturer restrictions relating to the use of the Equipment.

For specialized Equipment, including drones, the Renter is responsible for complying with all applicable aviation, privacy, municipal, provincial, and federal requirements.

19. Limitation of Liability

Daniel Mac Media Rentals will not be responsible for indirect, incidental, special, consequential, or economic losses arising from the rental or inability to use Equipment, to the extent permitted by applicable law.

This may include loss of business, loss of income, loss of footage, loss of data, missed opportunities, or other consequential losses.

The Renter is responsible for maintaining appropriate backups of photographs, video, audio, and other data created using rented Equipment.

Nothing in this Agreement is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

20. Data & Recorded Media

Daniel Mac Media Rentals is not responsible for lost, corrupted, deleted, or otherwise damaged photographs, video, audio, or other data recorded using rented Equipment.

The Renter should maintain appropriate backups of all important data.

Memory cards, storage devices, and other media supplied with Equipment should be returned unless specifically stated otherwise in the rental agreement.

21. Indemnification

To the extent permitted by applicable law, the Renter agrees to be responsible for claims, losses, damages, costs, or expenses arising from the Renter's misuse of Equipment, breach of this Agreement, negligence, unlawful use, or failure to comply with applicable laws.

22. Disputes & Governing Law

This Agreement will be governed by the laws applicable in the province of British Columbia, Canada, unless otherwise required by applicable law.

Any dispute should first be addressed directly with Daniel Mac Media Rentals in an effort to reach a reasonable resolution.

23. Changes to These Terms

Daniel Mac Media Rentals may update these Terms & Agreement from time to time.

The terms applicable to a particular rental will generally be those accepted by the Renter at the time the rental is confirmed, unless otherwise required by law or agreed in writing.

24. Entire Agreement

These Terms & Agreement, together with the applicable rental booking, order confirmation, pricing, and any additional written terms provided by Daniel Mac Media Rentals, constitute the agreement between Daniel Mac Media Rentals and the Renter regarding the rental of the Equipment.

If there is a conflict between these Terms and a specific written rental agreement, the specific written rental agreement will govern to the extent of the conflict.

25. Acceptance

By completing a rental booking, submitting payment, accepting delivery, or taking possession of Equipment, the Renter acknowledges that they have had an opportunity to review these Terms & Agreement and agrees to be bound by them.
